Terms of service

1. ELIGIBILITY & ACCOUNTS

You must be at least the age of majority in your country of residence to book. If you book for minors, you confirm you are their parent/legal guardian or have written consent. You are responsible for the accuracy of information you provide and for safeguarding any account credentials used on our site.


2. WHAT WE OFFER (TOURS & EXPERIENCES)

We aim to describe our tours accurately; however, nature and seasons in Northern Norway are dynamic. Photos are illustrative. Wildlife, aurora, snow, and weather conditions can never be guaranteed. Tour descriptions, inclusions, and availability may change at our discretion.


3. BOOKINGS & CONTRACT FORMATION

Placing a booking is an offer to purchase Services. A contract is formed only when we accept and confirm your booking in writing (e.g., confirmation email) after successful payment authorization. We may decline or cancel a booking (e.g., capacity, safety, or payment issues). If we do, we’ll notify you using the contact details you provided and refund any amount paid.

Gift cards and vouchers, if offered, are subject to their own terms.


4. PRICES, TAXES & BILLING

Prices are listed in NOK unless stated otherwise and generally include VAT where applicable. Prices, discounts, and promotions may change without notice. The price at checkout/confirmation applies. Currency conversion and card/bank fees are your responsibility.
You agree to provide current, complete, and accurate billing details and authorize us to charge your selected payment method for the total due (including VAT and any optional add-ons you select).


5. MEETING POINTS, PICK-UP & TIMING

Your confirmation states the meeting time and location (or hotel pick-up window, if included). You are responsible for arriving on time and being reachable by the contact details provided. Late arrival or no-show is treated under the Cancellation rules below. Title/risk in any rented equipment passes to you upon handover and returns to us upon check-in after the tour.


6. HEALTH, FITNESS & GUEST RESPONSIBILITIES

By booking, you confirm that you and anyone you book for:

  • Are fit for the selected activity and will disclose relevant medical conditions in advance.

  • Will wear suitable clothing/footwear and use provided safety equipment as instructed.

  • Will follow the guide’s instructions at all times; alcohol/drug use is not permitted during activities and may result in removal without refund.

  • Are responsible for personal belongings throughout the experience.

If in doubt about suitability, please contact us before booking.


7. WEATHER, SAFETY & ITINERARY CHANGES

Safety is our top priority. The guide of the day may adjust routes, timings, activities, or locations due to weather, daylight, road closures, avalanche risk, seasonal conditions, or other safety considerations. Such adjustments are part of Arctic travel and do not entitle you to a refund so long as a reasonably equivalent experience is delivered.


8. MINIMUM PARTICIPANTS (IF APPLICABLE)

Some tours require a minimum number of guests. If not met, we may offer to (a) run the tour as a private/low-capacity departure at a revised price (your choice), (b) reschedule, or (c) refund in full.


9. RESCHEDULING & CANCELLATIONS

By you:

  • Cancel ≥ 7 days before the tour → Full refund.

  • Cancel between 7 days and 48 hours50% refund.

  • Cancel < 48 hours or no-show → No refund.
    You can request one free reschedule up to 48 hours before departure, subject to availability.

By us (weather/safety/operational):
If we cancel due to unsafe weather or other circumstances beyond our control, you may reschedule (subject to availability) or receive a full refund. We are not liable for additional costs you incur (e.g., travel, accommodation).

Force Majeure:
We are not liable for non-performance caused by events beyond our reasonable control (e.g., severe weather, natural events, power outages, strikes, epidemics, governmental restrictions, road closures). Where possible we will offer rescheduling or a refund.

Right of Withdrawal (EU/EEA):
For leisure services with a specific date or period, the EU/EEA 14-day cooling-off period does not apply (Directive 2011/83/EU as implemented in Norway). Your rights are as stated in this section.


10. EQUIPMENT RENTAL & DAMAGE (IF PROVIDED)

If we provide or rent equipment (e.g., snowshoes, thermal suits), you must use it properly and return it in the same condition, normal wear excepted. You may be charged reasonable repair or replacement costs for loss or damage beyond normal wear.


11. RISK ACKNOWLEDGEMENT & LIABILITY

Participation in outdoor activities involves inherent risks (e.g., slips/trips, cold exposure, changing terrain, road conditions). By joining, you accept these inherent risks and agree to act prudently and follow safety instructions.

  • You are responsible for arranging personal travel insurance that covers the activity.

  • We are not liable for loss of personal belongings or for losses arising from following or disregarding the guide’s instructions.

  • Nothing in these Terms limits liability where such limitation is prohibited by mandatory law (e.g., for gross negligence or wilful misconduct). Your statutory consumer rights under Norwegian/EU law remain unaffected.


12. THIRD-PARTY PROVIDERS

Tours may involve services from third parties (e.g., transport providers). We are not responsible for acts/omissions of third parties we do not control, but we will use reasonable care in selecting reputable partners.


13. INTELLECTUAL PROPERTY

Site content (text, images, logos) is owned by Rise Adventures or our licensors and protected by applicable intellectual property laws. You may use the site for personal, non-commercial purposes only. You may not copy or exploit content without our written consent.


14. OPTIONAL TOOLS & THIRD-PARTY LINKS

We may provide access to third-party tools or link to third-party sites. These are provided “as is”. Your use is at your own discretion and governed by those third parties’ terms.


15. RELATIONSHIP WITH SHOPIFY

Rise Adventures uses Shopify to power our online store and checkout. Purchases are with Rise Adventures, not Shopify. You expressly release Shopify from claims arising from your transactions with us.


16. PRIVACY

Personal data is processed per our Privacy Policy [LINK] and, where applicable, Shopify’s privacy terms. Because we operate in Norway/EEA, we process personal data in line with the GDPR. See our Privacy Policy for details.


17. FEEDBACK & REVIEWS

By submitting reviews or feedback, you grant us a worldwide, royalty-free license to use and display them for marketing and service improvement, subject to applicable laws and platform rules.


18. ERRORS & CHANGES

We may correct errors, update information, or modify/cancel tours where necessary (e.g., pricing, availability, inclusions). If a material change affects a confirmed booking, we’ll contact you using the details you provided.


19. PROHIBITED USES OF THE SITE

You may not misuse the website (e.g., introduce malware, scrape, or infringe IP). We may suspend access for misuse.


20. TERMINATION

We may terminate or suspend access to the Services at any time for misuse or operational reasons. You remain liable for sums due up to termination.


21. WARRANTY DISCLAIMER

Except as required by mandatory consumer law, the Services are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation of the site.


22. LIMITATION OF LIABILITY

To the maximum extent permitted by Norwegian law, we shall not be liable for indirect or consequential losses (e.g., loss of profit, opportunity, or accommodation/transport costs). This does not exclude or limit liability that cannot be limited under mandatory law (including for death/personal injury caused by gross negligence or wilful misconduct). Your statutory rights remain unaffected.


23. INDEMNITY (WEBSITE MISUSE)

You agree to indemnify us for losses arising from your unlawful misuse of the website or material breach of these Terms, to the extent permitted by law.


24. SEVERABILITY; WAIVER; ENTIRE AGREEMENT

If any provision is unenforceable, the remainder remains in effect. Failure to enforce is not a waiver. These Terms (plus referenced policies) are the entire agreement governing your use of the Services.


25. ASSIGNMENT

You may not assign your rights without our consent. We may assign these Terms in connection with a reorganization or business transfer.


26. GOVERNING LAW & VENUE

These Terms and any dispute or claim (contractual or non-contractual) arising out of or in connection with them are governed by Norwegian law. The parties submit to the jurisdiction of the courts of Tromsø (Troms og Finnmark), without prejudice to mandatory consumer venue rights.

27. PHOTOGRAPHY & MEDIA CONSENT

During tours, our guides may take photographs or videos using company cameras. By participating in a tour, you acknowledge and agree that:

  • Media taken with company equipment (photos or videos captured by the guide on a Rise Adventures camera) may be used by Rise Adventures, free of charge, for marketing, promotional, and professional business purposes, including but not limited to use on our website, social media, printed materials, and advertising campaigns.

  • Rise Adventures will not sell your images to third parties unrelated to our business.

  • If you do not wish to appear in such media, you must inform your guide at the start of the tour. We will respect your request and make reasonable efforts to exclude you from promotional content.

  • Media taken with your own devices (phones, cameras) remains your property and will not be used by Rise Adventures without your explicit consent.


28. CHANGES TO THESE TERMS

We may update these Terms by posting a new version on our website. For material changes affecting existing bookings, we will provide notice per applicable law. Continued use of the Services after changes become effective constitutes acceptance.
